For over 30 years, Daniel J. Persing has been a well-respected attorney in the Capital Region having worked as a solo practitioner and a named partner at several Albany law firms. He joined the Herzog Law Firm as Counsel in 2016. Dan concentrates his practice in the areas of Litigation, Family & Matrimonial Law, Business Law, Non-Profit Counsel, Medical Malpractice, and Personal Injury. He has also served as an Adjunct Professor of Law at the Albany Law School of Union University since 2005. He presently chairs the Zoning Board of Appeals for the Town of Chatham, Columbia County.

Dan has a wide range of trial and medical malpractice experience. Early in his legal career, he served as Associate Counsel for the New York State Department of Health’s Bureau of Professional Medical Conduct where he investigated and prosecuted for physician misconduct. In the private sector, Dan has represented clients who have been injured by a doctor, hospital, or other medical professionals. This includes failure to diagnose, improper treatment, foreign objects left in the body during surgery, negligent care, failure to warn a patient of known risks, and improperly performed medical procedures. Similarly, he has litigated injury claims due to wrongful death, motor vehicle accidents, product liability, construction site accidents, and building safety.

Dan has served as counsel for companies and non-profits and is well versed in Corporate Law. His experience includes reviewing, drafting, and negotiating contracts and leases, business organization and structure, labor and employment matters, personnel, fiscal and corporate by-laws, real estate transactions, defending lawsuits or administrative claims, and business litigation matters. As an experienced litigator, Dan is experienced in other court matters such as civil litigation and family and matrimonial law.

Dan graduated from Albany Law School of Union University with a Juris Doctorate in 1981 and earned a B.A., cum laude, from Houghton College in 1977. He is a member of the New York State Bar Association and is admitted to the U.S. District Court for the Northern District of New York.
